CHAPTER 1
Introduction
Background, objective/purpose of this Information
Hand Book.
The object for preparation of this handbook is to
give an idea of transparency, accountability and
openness in Government Administration under Right to
Information Act, 2005. This information handbook
pertains to Excise (Abk) Department sets out the
obligation of Public Authorities concerned under
Section 4 (1) of the Right to Information Act, 2005.
Who are the intended users of this handbook? All
citizens, civil society organization, public
representatives, officers and employees of public
authorities including Public Information Officers
and Assistant Public Information Officer and
Appellate Authorities, Central and State Information
Commission etc.

The information of origination is given chapter wise
in the Index.
Getting Information:
The detail information is given in the Notification
No. 230/GEN/DOP dated. 22.12.205 issued by

CHAPTER 2
Organization, Function and Duties
Section 4( 1 )(b)( 1)
Particulars of the Organizations, functions and
duties:
I. Name & Address of the organization:
Excise (Abk) Department, Government of Sikkim
Gangtok-737101, M.G. Marg.
II. Function and Duties:
1. Matters relating to production and sale of
alcoholic drinks in
Sikkim.
2. Control and regulation of sale of opium and ganja
in Sikkim.
3. Settlement of Excise shops on auction/commission
basis.
4. Detection and prevention of illicit distillation
and sale.
5. Detection and trial of cases departmentally for
adulteration of unauthorized quality products.
6. Fixation of duty and selling rates of all
alcoholic drinks, ganja and
opium.
7. Realization of revenue.
8. Licensing and control or medicinal and toilet.
9. Issue of import and export permits.
10. The Narcotic Drugs and Psychotropic substance,
Act, 1985(Central Act 41 of 1985)
11. The prevention of illicit traffic in narcotic
Drugs and Psychotropic Substances Act, 1988(Central
Act 46 of 1988).

CHAPTER 3
POWER AND DUTIES OF
OFFICERS AND EMPLOYEES
Secretary:
The Secretary of the State Excise
Department functions as the Head of the Department
and is responsible for overseeing that the policies
of the government is implemented in its letter and
spirit. She accords approval and sanction to all
proposals as per the power delegated under the
Sikkim Finance Rule. Besides that she exercises
administrative powers as prescribed under the rules.
Commissioner:
The Commissioner Excise exercises
powers delegated to him and functions in accordance
with the provision of the Sikkim Excise Act, 1952.
The Act provides for the manufacture, possession,
sale, transport, import & export of alcoholic liquor
& imposition of duty of excise therein & for matters
connected therewith & incidental thereto
Joint Secretary:
Joint Secretary acts as Head of office and looks after all works
pertaining to the Administration and also acts as
Nodal Officer for signing sanctioned schedule. She
is appointed as State Public Information Officer
under RTI Act, 2005; she also acts as vigilance
officer for the department.
Joint Commissioner (F):
Joint Commissioner is overall Incharge of all field functionaries,
issue of licensees, renewal of license for East &
North Districts. He is the Incharge of intelligent
cell for all districts including manufacturing
units, compounded offences under Sikkim Excise
Act,1992
Dy.Commissioner (HQ):
Dy. Commissioner (HQ) assists Joint Commissioner (F) for all field
activities. He is Nodal Officer of Narcotic &
Psychotropic Substance Act, issue of duty free
permit for VIPs, godown registration of Distributors
& sub-Distributors. Renewal of licence of all
distributor/sub distributors. He compounded offences
enshrine in section 57 of the Sikkim Excise Act,
1992.
Sr. Accounts Officer:
Sr. A.O looks after all accounts works of the
department, budgeting maintenance of Revenue figures
Public Accounts Committee reconciliation in A.G.
Office. She is also appointed as Nodal Officer for
Finance Di ision of the department. She is entirely
responsible for submission of the
expenditure report to Finance Revenue & Expenditure
Department etc. signing of challans, maintenance of
fixed deposit receipt vendors.
Dy. Commissioner (D/B):
Dy. Commissioenr (D/B) is the controlling Officer of Distilleries &
Breweries, tests of laboratory. He is responsible
for collection of revenue from distilleries and
Breweries located in Sikkim, ENA.
Asstt. Commissioner (HQ):
Asst. Commissionr (HQ) assists the Dy. Commissioner (HQ), process the
file of Army/Civil/Label Registration and deals with
issue of import permit realization of duty and other
levies on IMFL imported from other states.
Dy. Commissioner (Jorethang):
Dy. Commissioner (Jorethang) is the Controlling Officer of South/West
District and Drawing & Disbursing Officer also. She
forwards all administrative and accounts work to
Headquarter. She is appointed as State Public
Information Officer for South/West District under RTI Act 2005. Grant of Excise license for methylated
spirit for South/West district, verification,
checking of excise shop and detection of illicit
cases under her charge and compounded offences under
Sikkim Excise Act, 1992. Issue of excise licenses
including methylated spirit routed through her for
consideration.
Under Secretary:
Under Secretary initiates all proposals pertaining to
administration as well as general works. She assists Jt. Secretary. She is appointed as Asstt. Public
Information Officer of the department and she is
also appointed as Record Officer of the Department.
Office Superintendent:
The main responsibility is to supervise that all
files and papers are timely put up by the
subordinate staffs and to forward the same to the
next higher officer with his details
notes/comments/suggestion duly quoting relevant
rules and instruction of the Government as quickly
as possible.
Sr. Accountant:
Sr. Accountant is responsible for timely preparation of all
bills, maintenance of proper accounts/cash book,
vouchers and to supervise his subordinate staffs.
Accountant (Expenditure):
To prepare bills, timely sending of all cheques to
Bank, LIC, telephone bills, PRE, power etc. timely
settlement of all TA bills.
Accountant (Revenue):
Accountant (Rev) is responsible of updating of revenue receipts
figure, preparation of data and timely sending of
revenue figure to FRED.
Head Assistant:
H.A is responsible for all Adm works, preparation of
data, list, timely disposal of files/papers etc.
Along with her other ministerial staffs also works
under office superintendent and similarly other
subordinate accounts staffs works under Sr.
Accountant.
Asstt. Chemical Examiner:
Asstt. Chemical Examiner is responsible for testing of alcohol, Beer etc
in laboratory and and maintenance of quality of
drinks manufactured in Sikkim as well as imported
from other States and forward the report to
Commissioner (Revenue) through his Controlling
Officer (D/B), Rangpo, maintain of records of
laboratory, under with him one Sr. Lab Assistant and
one Lab Assistant work. He is the Incharge of
Laboratory of Excise Department at Rangpo. |

CHAPTER 4
GENERAL
PROCEDURE FOLLOWED IN DECISION MAKING PROCESS.
Procedure in decision making is being made in
accordance with the manual of office procedures,
1998 and other rules, notifications etc are li e in
Chapter 6.
GENERAL PROCEDURE:
Dealing clerk of the particular section of the
department submits the case to the Office
Superintendent/concerned officer in the relevant
file of the concerned matter alongwith the reference
papers, relevant circular precedent book etc. The
office superintendent/concerned officer after
scrutinizing the note of the dealing clerk!
Assistant submits a comprehensive note with his
comments/suggestion if any to the section Head or
whosoever on the charge. The sectional head examines
the case thoroughly in accordance with the
Government Rules/departmental instructions as may be
issued from time to time and submits
notes/views/observations to the next higher
authority i.e. Commissioner who in his turn also
examine the case and forward the same to the
Secretary of the department with his
view/comments/advice on the matter. The Secretary
after going through the full notes/proposal either
makes decision or forward the same to the Minister-
Incharge for approval and cases requiring policy
decision are forwarded to the Chief Minister through
Chief Secretary. |

CHAPTER 5
For smooth and better function of the department
general instructio are being issued and advices are
taken from all officers and field executives through
monthly departmental coordination meetings and if
necessary internal orders are also issued. |
